By purchasing my services, the client is agreeing to the following terms.

I reserve the right to decline a commission request for any reason.

Client grants me the non-exclusive rights to observe and replicate Client’s own character design, reference material and other intellectual property for the use of the requested commissioned work.

Client warrants that the character design, reference material and other intellectual property provided to me are legally obtained and authorized for use by the Client.

Client warrants that they have the authority to enter this agreement, be the point of contact and is solely responsible for decisions and approval during the process.

If a client not reply within 30 days of receiving drafts or work in progress photos, I consider the commission cancelled by the client. In this case, already paid money will not be returned, drafts are not stored and I will proceed with any existing products at my own discretion.

Clients can request to have their order not publicly posted. Please notify me beforehand, additional fees may apply.

Both the Client and I acknowledge that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information) outside of the development of Work, that will not be visible to the public, shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.

Please consult me about the subject matter if there is any uncertainty.

I will not draw from descriptions alone, please provide some sort of visual reference with the order request. Found references are perfectly acceptable.
Ex. mood boards, stock photos, self taken photos, etc.

I retain copyright, ownership, redistribution and intellectual property rights. The client is purchasing my artist labor only.

I reserve the right to publish the artwork which includes but is not limited to display, advertising, printing, the artwork and work in progress on on websites, social media, portfolios, public broadcast channels, and more, exempting when some or all of these rights are transferred to the Client under express agreement or project specifications.

I reserve the right to modify and use any rejected work in progress and versions for other projects according to my discretion, under the condition that it does not infringe the Client's intellectual property rights and ownership of their likeness, character design, branding, identity design or any such trademarks.

Clients receive non-transferable usage rights to the artwork for personal use.

Clients may not claim ownership of the work as their own.

Clients may not edit, or redistribute the artwork without my authorization.

Full credit is required when posting commissioned art rightfully under Arkaingel where possible.

Any AI and blockchain related usage of my work is strictly prohibited under any circumstance. All such usage should be considered unauthorized.
✧ No derivatives of the work may be made into/minted/sold as NFT or other cryptocurrencies.
✧ No changes or adjustments may be made by machine learning or derived technologies.
✧ No derivatives of my work is not allowed to be created through the use of above-mentioned technologies.

Personal use means any non-profit use where no monetization of, or of content featuring, the artwork is involved.

Examples includes:
SNS profile pictures, banners, and posts with no direct monetization or sales.
Prints, framing, merch in personal spaces and not for mass distribution.
Display as part of designs on websites and channels excluding use in content of these websites or channels.

In the case of character trades that contains my artwork, Clients may include the purchased price into their value.

Commercial broadcast rights means usage of the artwork on streams, videos, advertisements and other content, or any similar monetized instances.
Stream Branding: Panels, Logos, Emotes, Overlays, Stingers, Thumbnails, etc.
Advertisement: Sponsorship posts, Event promotions, Merchandise promotions, etc.

Commercial distribution rights means selling or reselling the artwork to another party, as a part of any product or merchandising, or on another platform.
Physical Merchandise: Books, Prints, Stickers, Badges, Charms, Standees, Dolls, etc.
Digital Merchandise: Membership rewards, Digital wallpapers, Art for music on streaming platforms, etc.

Commercial usage if not included in the project type, listing, or specifications, is charged an additional one-time fee of +100-200% the product's original price depending on the exact usage.

Commercial distribution projects require additional discussion, please contact me through my contact information.

All payments will be issued via Stripe or Paypal invoice in USD unless discussed otherwise.

Alternate payment options include Ko-Fi and Arbum and must be discussed in the ordering process.

Payment is due up front. At least 50% down payment is required before I start.
Full payment is required to continue beyond a finalized sketch.

Please pay within 48 hours or notify me of an expected wait time. Failure to do so will result in termination of the order.

Payment plans available at request for orders over $100.

Price additives include but are not limited to: Complex details, Backgrounds, Rush deadlines.

Full refunds are only issued if I decide to cancel an order, if the commission has not been started, or if the sketch has not yet been approved.

Partial refunds can be issued if the sketch has not yet been approved.

There are no refunds after the sketch has been approved, all payments are finalized.

I will not accept hard deadlines at this time.

Completion time may vary. Factors that affect the delivery include: commission slot, complexity, day job hours, IRL issues, health condition.
Timeframe is generally within 1 week - 5 months.

Clients will be notified if there are any delays and kept updated on the progress of the order.

Clients can track their order progress through my notion queue or by contacting me.

Once I approve of the commission request, the client will be contacted via their listed socials.
If there is no response within 48 hours the commission slot will be forfeited.

I will start the commission after receiving full or 50% down payment.
Full payment is required to continue beyond a finalized sketch.

If payment is not received within 48 hours without prior notice, the commission will be cancelled.

Major revisions are only allowed during the sketching stage (ex. pose, character, outfit, setting).
✧ There is a maximum of 5 major revisions, any revisions after will incur an additional fee.

Minor revisions (ex. additional and/or missing details, color changes) are allowed during any of the commission stages.

Please be clear with what needs to be changed and feel free to use other works and photos as references.

After a commission is completed, only mistakes on made on my part will be revised without charge such as missing or incorrect features on the given reference. Any errors due to an unclear reference and/or description will not be revised. Minor revisions will incur an additional fee.

Throughout the commission process, I will be distributing updates to be sure the commission is on track.

If the client wants an update please feel free to contact me periodically. Some artworks may take more than a month to complete, so frequent updates may not be fulfilled.

General process visualized below, treatment may differ between commissions.

I cannot provide physical shipments of the commission.

I do not distribute editable PSD files or unsigned files for personal commissions.
Please inquire for commercial commissions, additional fees may apply.

All commissions are distributed digitally via email or other online contact platforms with a signed, high resolution, PNG/JPG file.

Clients can request a transparent background file isolating the character, or other file variations and types.
Some variations may not be possible without prior discussion before the clean up stage.

Invoices must be paid within 24 hours unless discussed otherwise. Failure to pay will reopen the adopt.

If a chargeback or refund request is received due to the buyer's irresponsibility, the payment will be considered a failure.
Ownership of the design will be revoked and the adopt will reopen for sales.

Payment plans available upon request for adopts over $100.

Please inform me beforehand if purchasing via third-party voucher or gifting the design to someone else upon purchase.

Auctions end 24-48 hours after the last bid with a 1 hour snipe guard.

Auctions with tiered AB options allow for higher tiered AB bids after lower AB bids if placed within the time frame of the snipe guard.

Additional purchases cannot be made if buyer has existing pending payments with me.

In the case the design belongs to a closed species, please be aware of the payment guidelines within the species.

I retain all rights over the artwork and reserve the right use it in my portfolio and social media content.

Design co-ownerships are allowed, however I am not responsible for co-ownership politics.

You can use the design as you wish for character creation purposes, gender, pronouns, history, outfits, etc. are all up to you.
Discriminatory usage of my designs will not be tolerated.

You can make minor changes to the design so long as the original elements are recognizable. Please retain a minimum of 50% of the original design.
✧ Please ask for my permission regarding editing my work, you may contact me for minor revisions but I am not required to accept.
✧ In the case the design belongs to a closed species, please be aware of changing species traits and bring it up with appropriate species staff.

You may make alternate versions of the design at your own discretion.
✧ In the case of the alternate versions belonging to a closed species, please refer to the species policy on alternate forms.

The original unedited version of the design must be kept for proof of ownership and for possible reversions in case of future ownership changes.

All parties of a transfer are responsible for familiarizing themselves with the TOS.
New owners must be made aware of this TOS, and will be held accountable if any terms are broken.

Designs may not be transferred to blacklisted users, anyone found deliberately doing so will be blacklisted as well.

You can sell/trade/gift the designs at your own discretion but cannot exceed the obtainment price without additional paid assets (eg. commission).
✧ Designs obtained via sale or voucher cannot be resold for more than its purchased price without additional paid assets added after obtainment.
✧ Designs obtained via trading cannot be resold or vouchered without additional paid assets added after obtainment.
✧ Designs obtained via gifting & free raffles cannot be traded or resold without additional paid assets added after obtainment.
✧ Designs obtained via a mixed offer cannot be resold for more than its purchased price without additional paid assets added after obtainment

Traded and gifted value do not count towards resale price, only the direct monetary value spent.
✧ Vouchers may only be used for designs obtained by monetary means for the equivalent value of their purchased price and additional paid assets added after obtainment, or if not obtained for monetary means, for the equivalent value of additional paid assets added after obtainment.
✧ Gifted artwork does not add to the resale value.

Designs with alternate forms must include the variants when being resold, traded, or gifted.
Those alternate forms may not continue being used separately from the original form unless significant design changes are made so it no longer resembles the original.

All designs have a 2 week cooldown before they can be transferred.
✧ In the case the design belongs to a closed species please be aware of cooldown times and other transactional guidelines within the species.

Notifying me of ownership changes is not required but appreciated.
✧ In the case the design belongs to a closed species, ownership changes must be brought up with appropriate species staff.

Users listed have been found violating TOS or are known scammers and are prohibited from obtaining any more designs.
